The legal age to consume alcohol in Georgia is 21. An underage individual can face charges just for possessing alcohol in the state. In light of this, the state’s Zero Tolerance law makes it a crime for minors to operate a vehicle with even a small amount of alcohol in their system. The legal blood alcohol content (BAC) for minors is only .02%. Depending on the person, having only one alcoholic drink can put an individual over the underage BAC limit.

Penalties for an underage drinking and driving offense depend on your BAC level. If it is between .02% and .08%, you may be sentenced to 20 hours of community service and a six-month license suspension. If, however, your BAC was above .08%, you can be charged with a standard DUI and could be sentenced to at least 24 hours in jail, 40 hours of community service and a one-year driver’s license suspension.
